The Foundation's mission includes advancing global dermatological prevention through AI innovation, supporting healthcare access in developing countries (particularly Africa), and providing technology free of charge to those in need.

Dermatoscope.ai is an AI-powered dermatological risk assessment and decision-support web application (Progressive Web App — PWA). The Service provides:

• AI Skin Analysis: Automated risk assessment using an ensemble of 15 AI models, analysing uploaded skin photographs to provide a probability-based risk classification.
• Medical Validation: Optional service where an IMC-registered doctor (Ireland) or OGYÉI-registered specialist (Hungary) reviews the AI analysis and provides a professional medical evaluation within 24 hours.

The Service is accessible exclusively via web browser. No native mobile application download is required.

IMPORTANT: THIS APPLICATION DOES NOT REPLACE IN-PERSON MEDICAL EXAMINATION.

• The AI analysis result does NOT constitute a medical diagnosis. It is informational data based on statistical probability only.
• The Service Provider does not accept liability for AI errors (false positive or false negative results).
• In urgent cases — sudden changes, bleeding, or pain — contact your doctor immediately or call emergency services.
• When Medical Validation is requested, clinical responsibility lies solely with the validating physician in accordance with applicable healthcare legislation.
• In Ireland: Liability is governed by the Medical Practitioners Act 2007 and the standard of care expected of a reasonably competent practitioner.
• In Hungary: Liability is governed by Act CLIV of 1997 on Health and the Civil Code.

In accordance with the Irish Medical Council's 2025 AI Position Statement: "AI complements, but does not replace, physician decision-making. The same professional and legal standards apply as with any other clinical tool."

• The Service may only be used by persons aged 16 or over. Persons under 16 require verifiable parental/guardian consent. Persons under 13 may not use the Service.
• You are responsible for the accuracy of the health information you provide.
• You must not attempt to reverse-engineer, hack, or compromise the integrity of the system.
• You must not upload images that are not of your own skin conditions (or those of a person for whom you have legal responsibility).
• You acknowledge that skin photographs constitute special category personal data under GDPR Article 9.

All prices are displayed in EUR and include applicable taxes.

• AI Analysis: Free of charge (included with Medical Validation).
• Medical Validation: €33.00 — includes AI analysis + professional medical review by a registered practitioner within 24 hours. If a prescription is medically indicated, it is included at no additional charge.

Payment Processing: All payments are processed securely by Stripe, Inc. (an Irish-founded company headquartered in Dublin). Accepted payment methods include: Visa, Mastercard, Apple Pay, Google Pay, and other methods supported by Stripe in your region.

Revenue: As a non-profit foundation, 100% of revenue supports the Foundation's mission of global dermatological prevention and healthcare access.

• AI Analysis: As the service is free, no refund applies.
• Medical Validation: If you do not receive a medical report within 72 hours of payment, you are entitled to a full refund.
• Technical Failure: If a technical error prevents the delivery of the service, you are entitled to a full refund or re-processing at no additional cost.
• Right of Withdrawal: Due to the nature of the service (immediate digital delivery), the right of withdrawal under EU Directive 2011/83/EU (Consumer Rights Directive) does not apply once the AI analysis has been initiated, provided you have given explicit prior consent and acknowledged that you lose the right of withdrawal.

The application, including its design, source code, AI algorithms, and all related materials, is the exclusive intellectual property of Derma2in1 Alapítvány.

Anonymised Data: By using the Service, you consent to the use of fully anonymised data (which cannot be linked back to you) for the purpose of improving the AI algorithms and for scientific research, subject to appropriate ethical approvals.

• The Service Provider does not warrant the accuracy of AI analysis results. AI technology has inherent limitations including false positive and false negative outcomes.
• The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by applicable law.
• The Service Provider's total liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the specific service that gave rise to the claim.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law.

• For users in Ireland: These Terms are governed by the laws of Ireland. Disputes shall be subject to the exclusive jurisdiction of the Irish courts.
• For users in Hungary: These Terms are governed by Hungarian law. Disputes shall be subject to the exclusive jurisdiction of the Budapest Metropolitan Court (Fővárosi Törvényszék).
• EU Online Dispute Resolution: Under EU Regulation 524/2013, you may use the European Commission's ODR platform for consumer disputes: https://ec.europa.eu/consumers/odr

We reserve the right to modify these Terms. Material changes will be communicated via email or prominent notice within the application at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
